Please note that while the tinnys and ski boat require a valid boat licence, the Pontoon Boat only requires a full driver's licence. Standard Cancellation Policy Cancellations notified more than 90 days prior to departure will be entitled to a full refund of moneys paid less $50 cancellation fee. Cancellations notified less than 90 days and more than 45 days prior to departure will forfeit all moneys paid unless the boat can be re-booked for its full hire fee, in which case, all moneys paid will be refunded less $100 cancellation fee. Cancellations notified less than 45 days prior to departure will forfeit all moneys paid unless the houseboat can be re-booked for its full hire fee, in which case, all moneys paid will be refunded less $200 cancellation fee. All cancellations and changes must be in writing and emailed to riverlandboathire@gmail.com to be approved. Please note: Travel Insurance is recommended to cover any unforeseen circumstances or losses. Policy for requests to change, transfer or re-schedule you’re booking. We will accept one request to change, transfer or re-schedule you’re booking. This must be notified more than 45 days prior to departure, to be accepted. Notifications less than 45 days prior to departure will forfeit all moneys paid unless the boat can be re-booked for its full hire fee, in which case, your booking request will be accepted. More than 2 booking requests will be deemed as a cancellation and the terms and conditions set out in the Standard Cancellation Policy will apply. All cancellations, requests to change, transfer or re-schedule you’re booking must be in writing and email to riverlandboathire@gmail.com to be approved. Riverland Boat Hire reserve the right to refuse requests to change, transfer or re-schedule bookings at their own discretion. Please note: Travel Insurance is recommended to cover any unforeseen circumstances or losses Terms and Conditions of agreement for hire 1) The owner will provide instruction to the hirer/operator in respect of 1.1 the operation of the boat and its accessories including emergency equipment and 1.2 the River Murray and inland waters Navigation Regulations and other regulations and rules 2) The hirer will comply with all directions by the owner concerning operation of the boat and its accessories and will comply with the river Murray and Inland waters navigation regulations and all other relevant navigation rules regulations and bylaws 3) The hirer personally accepts full responsibility for the care and safety of the boat (Which term includes all its fittings equipment and accessories) and also accepts full responsibility for the actions of all persons on board during the period of hire. 4) Any Boat items or equipment noted by the hirer to be damaged prior to the beginning of the hire period should be brought to the attention of the owner at the time of the pre hire inspection 5) The hirer is liable for the cost of the repair of any damage sustained to the boat and its fittings equipment or accessories during the period of hire. Any damage must be reported to the owner as soon as possible. Damaged items will at the owner’s option and at the hirers cost be either repaired or replaced. 6) The hirer is liable for the replacement of any items missing from the boat inventory at the end of the hire period. The owner may require the hirer to inspect and sign a written ‘boat inventory’ 7) The hirer will pay the cost of any extra fuel used outside the agreed hire terms 8) The hirer will not 8.1 permit more persons to be on board the boat than the maximum stated overleaf 8.2 permit any person to operate the boat who is 8.2.1 under the age of 18 years or does not possess and produce for notation by the owner a current full vehicle driver’s license or boat operators license 8.2.2 under the influence of alcohol or drugs 8.2.3 has not been given instructions in respect to the relevant navigation rules and regulations 8.3 drive navigate or move the boat after sunset or before sunrise (or permit anyone else to do so) 8.4 take or permit to be taken the boat down the river from the wellington ferry 8.5 take or permit to be taken the boat out of the main course of the river 8.6 tow or permit an occupied craft to be towed by the boat unless with the permission of the owner which will be endorsed on this agreement 8.7 adjust or interfere with or permit any other person to adjust or interfere with the operation of the motor or any of the boats fittings or equipment 8.8 do or cause or permit to be done anything on or to the boat or any of its fittings equipment or accessories which may result in damage or injury to any persons or property 8.9 permit any person for any reason whatsoever to be on any of the boat structures 8.10 permit to be brought on the boat any of the following namely 8.10.1 axes or saws of any type trail or motor bike firearms or offensive weapons of any type 8.10.2 any electrical or gas appliances any pets or other animals unless with the permission of the owner which will be endorsed on this agreement 8.10.3 any dangerous noxious corrosive toxic or poisonous substances including in particular petrol or diesel or other flammable liquids 8.11 use or permit to be used the emergency equipment except of in case of an emergency and any such use will be reported to the owner as soon as possible 9) If the hirer breaches any of the terms or conditions of this agreement the owner may terminate the hire period without prejudice to the owner’s other rights and remedies under this agreement 10) The owner will endeavor to keep the boat motor and all fittings equipment and accessories in good working order during the hire period provided that the hirer will not be entitled to any compensation in respect of any loss or damage sustained as a result of the unforeseen mechanical breakdown or equipment failure or any loss of time resulting from such breakdowns or failures during the hire period or as a result of any restriction to the use of the boat during the hire period resulting from the breakdown or river or weather conditions or other unforeseen circumstances. 11) If due to unforeseen circumstances the boat is not available at the nominated mooring point at the beginning of the hire period and/or cannot be returned to the nominated mooring point at the end of the hire period the owner reserves the right to nominate an alternative mooring point. 12) Loss/Damage: The hirer is liable for any loss damage or injury to any person or to any property which may result from anything done by the hirer or by any person on board the boat. The amount payable by the hirer pursuant to this clause is not limited by the amount of security bond. To the full extent permitted by law the hirer releases and discharges (and hirer hereby indemnifies) the owner and its agents and employees from and against 12.1 all claims demands and costs on the owner; and 12.2 any loss or damage whatsoever and whenever caused to the hirer or its invitees whether by way of death of or injury to any person of any nature or kind accident or damage to property delay financial loss or otherwise; arising directly or indirectly from or incidental to a breakdown of or defect in the goods or any accident to or involving the boat or its use operation repair or maintenance (whether occasioned by the negligence of the owner or otherwise) or which may otherwise be suffered or sustained in upon or near the boat.
